Session Description: Labor laws. They’re so complex. And the newest regulations regarding independent contractors (beginning around 2019) have caused major upheavals in the businesses of independent contractors as well as employers. This webinar will provide an overview of the guidelines surrounding the classification of an independent contractor and the current status of recently enacted and pending legislation.

Learning Objectives*

  1. Learn what the ABC test is and why it was developed.
  2. Learn about the IRS “common law” definition of an independent contractor.
  3. Understand what California’s AB-5 is and how it impacted independent contractors.
  4. Understand the six factors of the US Department of Labor regulation that went into effect March 11, 2024 (Fair Labor Standards Act, RIN 1235-AA43).
  5. Understand the current status of the Congressional Review Act resolution to overturn the DOL’s independent contractor rule.
